Consumer Rights — When Goods or Services Fail You

You have a legal right to compensation for defective goods, deficient services, unfair trade practices, and misleading advertisements. Here's what the Consumer Protection Act, 2019 gives you.

The Consumer Protection Act, 2019 replaced the older 1986 Act and significantly expanded consumer rights in India. You are a "consumer" if you bought goods or hired services for a consideration (not for resale or commercial purposes — with an exception for self-employment) — this includes online purchases, offline stores, service providers like doctors, lawyers, contractors, telecom operators, banks, insurance companies, and more. The Act gives you the right to be protected against hazardous goods, right to be informed about quality and price, right to choose, right to be heard, right to redress, and right to consumer education. You can file complaints at three levels — District Commission (up to Rs. 50 lakh), State Commission (Rs. 50 lakh to Rs. 2 crore), and National Commission (above Rs. 2 crore).

How long do I have to file a consumer complaint?
Two years from the date the cause of action arose — that is, the date the defective product was delivered, the deficient service was provided, or the seller/provider refused to remedy the problem. The Commission can condone delay beyond 2 years if you show sufficient cause, but must record its reasons in writing. Do not rely on this — the safer course is always to file within the 2-year window.

Where do I file — District, State, or National Commission?
Based on the value of the goods/services plus compensation claimed: up to Rs. 50 lakh at the District Commission of your district (or where you or the seller resides / carries on business); Rs. 50 lakh to Rs. 2 crore at the State Commission; above Rs. 2 crore at the National Consumer Disputes Redressal Commission (NCDRC). You can also file online at edaakhil.nic.in — the government's official consumer e-filing portal — regardless of location.

What can I ask for as relief?
The Commission can order any combination of: repair or replacement of the goods, refund of the amount paid, compensation for loss or injury, compensation for mental agony and harassment, punitive damages (in cases of gross negligence), withdrawal of hazardous goods from sale, discontinuation of unfair trade practices, and payment of costs of the proceeding. You should specifically claim each of these in your complaint rather than leaving it to the Commission to decide.

Do I need a lawyer to file a consumer complaint?
No — you can file and represent yourself in the District Commission, and many people do. The procedure is designed to be accessible. A lawyer can help significantly for complex cases (medical negligence, insurance disputes, real estate) or if the opposing party has legal representation. There is no filing fee for consumer complaints in the District Commission for claims up to Rs. 5 lakh; nominal fees apply thereafter.
