The three-tier structure

Revised by the Consumer Protection (Jurisdiction) Rules, 2021 (w.e.f. 30 Dec 2021). The Supreme Court upheld this consideration-based test in April 2025.
Where you can file (territorial)
- Where the opposite party resides, carries on business, has a branch office, or works for gain
- Where the cause of action arose, wholly or in part
- Where you (the complainant) reside or personally work for gain
Filing checklist
- Your name, description and address
- Opposite party's name, description and address
- Facts of the complaint — when & where the cause of action arose
- Supporting documents — bill/invoice, warranty, receipts, correspondence
- Relief sought — refund / replacement / compensation / removal of deficiency
- Value of consideration paid (fixes the tier)
- Signature with verification; prescribed (nominal) court fee
File online via the official E-Daakhil portal (edaakhil.nic.in).
Time limits
Limitation to fileWithin 2 years of the cause of action (condonable for sufficient cause).
Appeal: District → StateWithin 45 days of the order.
Appeal: State → NationalWithin 30 days; person ordered to pay must deposit 50% of the amount.
