It backed down within hours, but the questions it raised have not gone anywhere.<\/p>\n<p>A Convocation Invite, and What It Set Off<\/p>\n<p>The dispute began with something ordinary. NALSAR University of Law, Hyderabad, one of the country&#039;s premier national law schools, invited Chief Justice of India Surya Kant to its convocation. Some students campaigned against the invitation. Student objections to convocation guests are not new at Indian universities, and they usually end where they begin, in internal debate.<\/p>\n<p>This one did not. On 13 August 2026, the Bar Council of India issued letters directing state bar councils to defer the enrolment of NALSAR&#039;s entire graduating batch as advocates, citing the campaign against the Chief Justice&#039;s proposed presence. In plain terms: because some students had protested an invitation, none of the graduates would be allowed to become lawyers, for now.<\/p>\n<p>To understand the weight of that, you have to understand what enrolment is. A law degree, on its own, does not make you an advocate. Under the Advocates Act, 1961, a graduate must enrol with a state bar council to practise. Enrolment is the single gate through which every lawyer in India passes. Deferring it for a whole batch, indefinitely, over a protest, meant holding the careers of an entire graduating class hostage to the conduct of some of its members.<\/p>\n<p>The Reversal, and the Part That Did Not Get Reversed<\/p>\n<p>The reaction was immediate, and by that same day the BCI withdrew the direction, within hours of issuing it. But the withdrawal came with a rider that kept the controversy alive. The Council sought an inquiry report from the university identifying the students who were &quot;principally instrumental&quot; in the campaign against the invitation.<\/p>\n<p>That demand shifted the question rather than settling it. A blanket enrolment bar had become a request to name individual students, with the obvious implication that consequences might follow for those named. For students weeks away from entering a profession regulated by the very body making the demand, the message was not subtle.<\/p>\n<p>The Solidarity Statement<\/p>\n<p>What happened next turned a NALSAR dispute into a national one. More than 700 members of the National Law School of India University, Bengaluru community, 165 graduating students, 409 current students and 128 alumni, issued a public statement in solidarity with NALSAR, demanding an unconditional apology from the BCI to NALSAR&#039;s students and faculty.<\/p>\n<p>The statement went further than sympathy. It made a legal argument: that BCI Chairman Manan Kumar Mishra does not represent the full Council, which includes the Attorney General, the Solicitor General and one member from each state bar council, and that the Chairman had no power to unilaterally bar a batch from enrolment. The students were, in effect, telling the profession&#039;s regulator that it had acted outside its own constitution.<\/p>\n<p>They also objected to Mishra and Chief Justice Surya Kant attending NLSIU&#039;s own convocation, which had been announced on 3 August for 12 September. The Chief Justice, to his credit, engaged rather than escalated: he reportedly held a ninety-minute dialogue with NLSIU students to understand their concerns.<\/p>\n<p>An Empty Hall<\/p>\n<p>On 27 August, NLSIU announced that its 34th Annual Convocation would not be held, citing &quot;unavoidable circumstances.&quot; Degrees would be conferred in absentia, with certificates couriered to graduates or collected from campus.<\/p>\n<p>Strip away the administrative language and the image is stark. One of India&#039;s most storied law schools, the institution that created the national law school model, will graduate a batch without a convocation, because the question of who could safely stand on that stage had become too contested to answer.<\/p>\n<p>The Legal Questions Underneath<\/p>\n<p>It would be easy to treat this as a personality dispute. The harder and more important questions are structural, and they will outlast the episode.<\/p>\n<p>The first is about the enrolment power itself. The Advocates Act sets out who is qualified to enrol and the narrow grounds on which enrolment can be refused, grounds that concern the individual applicant, such as conviction for offences involving moral turpitude. Nothing in that framework contemplates deferring enrolment for an entire batch because of a protest by some of its members. Collective consequences for individual conduct sit uneasily with basic principles of natural justice, and the right to practise a profession is protected under Article 19(1)(g) of the Constitution, subject only to reasonable restrictions. Whether a regulator can use the enrolment gate as an instrument of institutional displeasure is a question the withdrawal avoided rather than answered.<\/p>\n<p>The second is about student expression. The underlying conduct being punished, or nearly punished, was a campaign against a convocation invitation: criticism, organised and public, of a decision by a university and implicitly of the dignitaries involved. If the price of that kind of expression can be a threat to one&#039;s professional future, the chilling effect reaches every campus in the country. Law students, of all people, are trained to test authority with argument. A regulator responding to argument with career consequences teaches a different lesson entirely.<\/p>\n<p>The third is about the demand for names. Even after the enrolment threat was withdrawn, the request that the university identify students &quot;principally instrumental&quot; in the campaign kept an individualised threat in place. Universities asked to become instruments of a regulator&#039;s inquiry into lawful student expression face their own dilemma, between institutional relations with the body that accredits their graduates and their duty to the students in front of them.<\/p>\n<p>The Same Regulator, Seen From Above<\/p>\n<p>There is an irony in the timing that this magazine cannot ignore. In the very same fortnight, on 4 August, the Supreme Court was examining the bar councils from the other direction. Hearing petitions on elections to the BCI and state bar councils, a Bench of Chief Justice Surya Kant and Justices Joymalya Bagchi and V. Mohana observed that bar councils have become &quot;men&#039;s clubs&quot; whose monopoly &quot;has to be completely dismantled,&quot; and ordered two co-opted women members into every state bar council.<\/p>\n<p>Hold the two images side by side. In one, the profession&#039;s regulator reaches down to threaten students for protesting. In the other, the country&#039;s highest court reaches down to reform the regulator&#039;s own composition. August was the month the gatekeepers discovered that gates open in both directions.<\/p>\n<p>Where This Leaves the Next Generation<\/p>\n<p>The immediate crisis has passed. NALSAR&#039;s graduates can enrol. NLSIU&#039;s graduates will get their degrees, by courier if not on a stage. But roughly speaking, every law student in India watched a regulator demonstrate, even briefly, that it considered batch-wide enrolment a lever it could pull in a dispute about speech. That memory will not courier away.<\/p>\n<p>The episode also leaves the BCI itself at a crossroads it did not choose. Its authority over the profession is real and necessary; someone must set standards, conduct discipline, and guard entry against the genuinely unfit. But regulatory authority survives on the perception that it is exercised within rules, for regulatory reasons. A power used, however briefly, to answer criticism is a power that invites exactly the scrutiny it received, from students below and, on present form, from the Court above.<\/p>\n<p>The gate to the profession is still standing.
