Every month this column writes about consumer disputes, and every month the honest subtext is the same: the formal route is slow. Consumer commissions are better than civil courts, but pendency is real, adjournments happen, and a refund worth a few thousand rupees can cost more in time than it returns in money. Which is why the quietest legal event of August deserves a consumer's attention. Under the Supreme Court's SAMADHAN SAMAROH 2026 initiative, a special Lok Adalat held from 21 to 23 August settled or disposed of 1,712 pending cases in three days, with judges presiding over the settlements.<\/p>\n
What a Lok Adalat Actually Is<\/p>\n
A Lok Adalat, constituted under the Legal Services Authorities Act, 1987, is a forum where pending cases, and disputes not yet filed, are settled by agreement between the parties, with a bench typically comprising a judicial officer and other members guiding the process. It is not a court hearing in the adversarial sense. Nobody wins arguments. The question on the table is a narrower and often more useful one: what resolution can both sides live with today, instead of an order one side gets years from now.<\/p>\n
Three features make it unusual. First, a Lok Adalat award has the force of a civil court decree, it is binding and executable, not a soft promise. Second, there is no appeal against the award, because it records what the parties themselves agreed; finality is the whole point. Third, it costs nothing, and where a pending case is settled, the court fee already paid is refunded.<\/p>\n
Where It Fits for Consumers<\/p>\n
Consumer disputes are, in fact, natural Lok Adalat material. Most of them are ultimately about money: a refund, compensation for a deficient service, settlement of a billing dispute, an insurance claim amount. Disputes of that shape, where the disagreement is about how much rather than about principle, settle well. Bank recovery matters, insurance claims, telecom and utility billing disputes, and pending consumer commission cases are all routinely listed in Lok Adalats, including the National Lok Adalats held periodically through the year across the country.<\/p>\n
What a Lok Adalat is not suited for is a dispute where you want a precedent, a finding of fault, or exemplary damages, or where the other side has shown no willingness to resolve anything. Settlement requires two parties who prefer resolution to attrition. Where the opposite party is simply stonewalling, the formal route, with its coercive powers, remains the right one.<\/p>\n
How to Actually Use It<\/p>\n
If you have a case pending before a consumer commission or court, you can request, through the forum or the concerned Legal Services Authority, that it be referred to the next Lok Adalat. If your dispute has not yet been filed, you can approach the District Legal Services Authority directly for a pre-litigation reference, which resolves the matter without a case ever being instituted. Come prepared the way you would for any negotiation: know your documents, know the minimum you will accept, and know what you are willing to trade for speed. A settlement at eighty percent of your claim, received this month, is often worth more than a hundred percent ordered three years from now, and that arithmetic, not any romance about compromise, is the honest case for the mechanism.<\/p>\n
The Pattern Worth Noticing<\/p>\n
This column has said for months that documentation decides consumer outcomes. Lok Adalats do not change that; a well-documented claim settles better because the other side can see what a formal forum would eventually do with it. What changes is the clock.
