A high court division bench comprising Justice Ahsanuddin Amanullah and Justice Sunil Dutta Mishra, while hearing a writ application of one Abhishek Anand, asked the said officers to remain personally present in the court on December 1.
Senior counsel Satya Darshi Sanjay alleged that the entire episode of evicting his client from the outer premises of the Bihar State financial Corporation office without invoking the provisions of eviction laws was “heinous” and unknown to the provisions of law. “My client was not given any notice before his restaurant was bulldozed in presence of the magistrate,” he said.
“The restaurant was leased by BSFC and the latter was required to approach a civil court seeking a decree of eviction. Instead of following the law, the managing director, at the instance of industry secretary, wrote to the Patna DM for deputing the force to bulldoze the restaurant,” Sanjay informed the court.
Meanwhile, the high court has also summoned Sandeep Pondrik, the principal secretary of industry department and managing director of BIADA in a matter involving non-allotment of BIADA land for superspecialty hospitals in Patna..
The division bench of Chief Justice Sanjay Karol and Justice Partha Sarthy, while hearing a writ petition of a private firm, directed the principal secretary to appear before it on Wednesday.
