After the complaint surfaced, the Centre put the officer under suspension.
The Delhi High Court had earlier granted Jitendra Narain interim protection from arrest till October 28. The officer had moved the Delhi HC after a joint Delhi Police and Andaman and Nicobar Police team raided his home on October 18.
Narain then moved before the Calcutta High Court’s Port Blair circuit bench praying that the interim protection be extended till November 14, when the Post Blair bench reconvenes, and he is able to make a formal appeal for anticipatory bail.
A division bench of justices Bibek Chaudhuri and Prasenjit Biswas, which heard the plea on October 21, allowed the plea but asked the officer to appear before SIT for questioning. The HC in its order also said, “We are not unmindful to note that the above mentioned case requires immediate investigation …”
The officer was asked to appear before SIT on days asked. The SIT had to inform his advocate two days in advance. The HC allowed the SIT not only to question him, but also conduct his medical examination and any steps they might need to take.
Till his suspension on October 17, Narain was chairman and managing director of the Delhi Financial Corporation. The Centre had transferred Narain from Port Blair to Delhi on July 21, 2022.
On September 30, a complaint was filed in court alleging police inaction (section 156(3) CrPC) against Narain. Based on court orders, the Aberdeen police station registered an FIR on October 1 for gang rape. The survivor had alleged that the officer — and others — had raped her first on April 14 and again on May 1.
