The court was hearing the criminal appeal preferred by Karuppaiah Kannan challenging the conviction and life sentence imposed by the I additional and sessions court in Madurai in 2019.
The case of the prosecution is that the deceased Vadamugam was working as a watchman in a farm in Madurai district. Kannan who owned a land near the farm used to enter the farm where Vadamugam was working and used to take away coconut and mangoes. Since Vadamugam had warned Kannan several times, there was an enmity between them.
On April 29, 2015, Kannan entered the farm and was trying to take away the rope from the motor pump set room. Vadamugam had warned him. Later in the day, Kannan entered the farm and attacked Vadamugam using a billhook. Vadamugam died on the spot.
A division bench of justices J Nisha Banu and N Anand Venkatesh observed that the court carefully went through the order and judgment passed by the trial court.
The trial court has properly appreciated the evidence and rendered a correct finding to the effect that the prosecution has made out a case for murder against the appellant beyond reasonable doubts and there is no ground to interfere with the same. Hence, the judges dismissed the appeal.
